INTELLECTUAL PROPERTY (IP) POLICY

Platform: DealRockets

DealRockets, operated by Daz Commerce, is committed to maintaining a marketplace that respects and protects the intellectual property rights of creators, brands, manufacturers, and rights holders worldwide. This policy outlines the responsibilities of Suppliers, Buyers, and Rights Holders, as well as the procedures for reporting and resolving IP-related disputes.


1. General Principles

1.1 Commitment to IP Protection

DealRockets respects all forms of Intellectual Property, including but not limited to trademarks, copyrights, patents, industrial designs, trade dress, trade secrets, and proprietary images.

It is our policy to remove or restrict access to any content that we reasonably believe, in good faith, to be infringing or unlawfully using another party’s intellectual property.

1.2 Compliance Requirement

By using DealRockets, all Suppliers affirm and warrant that:

  • They have full legal rights to sell, distribute, or display the products they list.

  • Their listings do not infringe any IP rights under applicable laws, including the Lanham Act, DMCA, TRIPS Agreement, EU IP regulations, and other global IP frameworks.

  • They will provide evidence of authorization upon request.

DealRockets may, at its discretion, request invoices, authorization letters, or production documentation to confirm product authenticity.


2. Prohibited Content

To protect rights holders and maintain marketplace integrity, the following content is strictly prohibited:

2.1 Counterfeit Goods

Items that bear a trademark, logo, or brand identifier but were not manufactured, licensed, or endorsed by the official brand owner (e.g., Nike, Rolex, Apple).
This includes unauthorized replicas of packaging, labels, holograms, and authentication cards.

2.2 Replicas, Knock-Offs, and Trade Dress Imitations

Products that mimic the design, appearance, packaging, or unique trade dress of well-known brands, even if the actual brand name is not displayed.

2.3 Unauthorized Images or Media

  • Product photos stolen from brand catalogs, competitors, or copyrighted websites

  • Marketing materials, diagrams, brand photography, or videos used without permission

  • Images generated by AI models trained on copyrighted materials without authorization (where applicable)

2.4 Illegal or Restricted Designs

Items infringing on active patents, protected industrial designs, or proprietary molds, including consumer electronics, machinery components, and specialized tools.

DealRockets reserves the right to remove listings that “appear suspicious” or raise IP concerns, even prior to receiving an official notice.


3. Notice and Takedown Procedure

Consistent with global safe-harbor regulations (such as DMCA §512), any legitimate IP Rights Holder may submit a Notice of Infringement.

To file, the Rights Holder must send a detailed notice to legal@dealrockets.com including:

  1. Identification of Ownership:

    • Trademark registration certificate

    • Patent number (registration or application)

    • Copyright certificate

    • Other evidence proving ownership or exclusive rights

  2. Exact Location of the Alleged Infringement:

    • Specific URLs to the listings in question

    • Screenshots or reference numbers where appropriate

  3. Good-Faith Statement:
    A declaration that the IP owner believes the material is not authorized by the rights holder, its agents, or the law.

  4. Affidavit Under Penalty of Perjury:
    A statement certifying that all provided information is accurate and that the filer is authorized to act on behalf of the IP owner.

Incomplete notices may be rejected until sufficient information is provided.


4. Counter-Notice Procedure

If a Supplier believes a removal was made in error, they may file a Counter-Notice to request reinstatement of the listing.

A valid Counter-Notice must include supporting evidence such as:

  • Official distribution or reseller authorization letters

  • Manufacturer invoices, certificates of origin, or production documentation

  • Proof of original design creation (CAD files, design registration certificates, brand ownership documents)

DealRockets will review the Counter-Notice within 10 business days and may reinstate the listing unless the Rights Holder initiates formal legal action.
Knowingly submitting a fraudulent Counter-Notice may result in permanent account termination.


5. Repeat Infringer Policy (“Three Strikes” Rule)

DealRockets enforces a strict, platform-wide Repeat Infringer Policy to maintain a trusted environment.

  • First Violation:
    Listing removal + formal warning email + educational resources on IP compliance.

  • Second Violation:
    Listing removal +
    14-day account suspension + mandatory compliance review.

  • Third Violation:
    Permanent account termination, blacklist of the business entity and all associated responsible persons.
    No refunds of membership fees or subscriptions will be provided.

Severe violations (high-volume counterfeiting, fraud rings, or law enforcement requests) may result in immediate termination without following the three-step sequence.


6. Brand Protection Cooperation

Daz Commerce actively cooperates with global brands, customs authorities, and law enforcement agencies to identify and eliminate counterfeit activity.

6.1 Information Sharing

Upon receiving lawful requests (court orders, subpoenas, etc.), DealRockets may share relevant user information in accordance with privacy and data protection laws.

6.2 Safe-Harbor Protection

As an online intermediary platform, DealRockets operates under safe-harbor provisions that limit platform liability when:

  • The platform does not have actual knowledge of infringement; and

  • The platform removes infringing content promptly after receiving valid notice.

6.3 Preventive Monitoring

DealRockets may use automated or manual moderation tools to detect likely counterfeit items, high-risk categories, or repeat offenders before listings are made public.


7. Legal Consequences

Deliberate sale or distribution of counterfeit goods may result in:

  • Permanent platform removal

  • Reporting to local or international law enforcement

  • Civil or criminal liability under applicable laws

  • Seizure of goods by customs authorities

  • Litigation initiated by IP Rights Holders

Users are responsible for ensuring their listings comply with all relevant IP laws in their jurisdictions.
